________________________ DECISION ON COSTS ________________________ Hon Kwan VP (giving the Decision on Costs of the Court): 1.On 1 March 2023, we handed down our judgment allowing the appeal of the appellant with costs against the Nursing Council of Hong Kong. We directed the costs of the appellant be assessed summarily. The appellant has lodged a statement of costs for this purpose and the Council its statement of objection. 2.Having considered the statement of costs and the objections, we assess the amount of reasonable costs allowed to the appellant at $252,175. 3.We have disallowed item C2.5, being the costs in respect of drafting and finalising the statement of costs for summary assessment. It is provided in Practice Direction 14.3 para 13 that a broad-brush approach is taken by the court in summary assessment and costs for gathering information and drafting of the statement of costs for this purpose will generally not be granted. We see no reason to make an exception here.
