Please note the following corrigendum for the Judgment dated 22 August 2023: -

1.In paragraph 31 at page 19 between line G and line H,

“The applicant’s summons for extension of time is accordingly dismissed with costs.” should read

“R3’s summons for extension of time is accordingly dismissed with costs.”

2.In paragraph 32 at page 19,

“Pursuant to Order 59 rule 2A(8), we also order that as the application is wholly without merit, no party may request this determination to be reconsidered at an oral hearing inter partes.” should read

“Pursuant to Order 59 rule 2A(8), we also order that as R3’s application is wholly without merit, no party may request this determination to be reconsidered at an oral hearing inter partes.”
