The plaintiff claimed costs of $143,166 which includes counsel’s fee of $35,000 (for drafting affidavit in opposition and written submissions) in respect of its application for security for costs of the appeal. We assess the party and party costs at $83,000 which includes $35,000 for counsel’s fee.
