There are some doubts in our mind as to whether the second question even arises on this appeal and perhaps as to whether the first falls squarely upon the decision of this court. But be that as it may, this case is one on its peculiar facts and one would hope that similar facts are not likely to arise again.

If the Court of Final Appeal considers it right to exercise its discretion to permit an appeal, then so be it, but we consider it appropriate for that decision to be taken by them and leave not be given by this court.
