Arbitration — Enforcement of arbitral award — Application to set aside Enforcement Order under Order 73 rule 10(6) — Abuse of process — Application to amend set aside application — Application for stay of enforcement — Costs. The applicant G sought enforcement of an arbitral award against the 1st Respondent X and others. After inter partes substantive hearings, the Court granted the Enforcement Order on 19 December 2023. X subsequently applied under Order 73 rule 10(6) to set aside the Enforcement Order, and to amend the application, which the Court dismissed as an abuse of process because the issues had been fully argued and determined. The Court held that the procedural rules did not allow repeated arguments after the order was made and that an application under rule 10(6) was not a proper method to re-litigate the matter. An application for stay of enforcement was adjourned for further arguments, with no interim stay granted. Costs were ordered against X on the set aside and amendment applications, with the costs of the stay application reserved. The Court warned against further unreasonable applications, noting potential wasted cost sanctions. Key statutory provisions included Section 92(1) Arbitration Ordinance (Cap 609) and Order 73 rules. The decision in CNG v G & G [2024] HKCFI 575 was referred. Outcome: dismissal of set aside and amendment applications, adjournment of stay application, costs awarded to G.
