1. 申請人是位於香港上環太平山街二十四號六樓B座天台（“處所”）的業主，而答辯人是有關處所的租客。雙方同意處所的租賃是從1978年7月1日開始，雙方沒有簽署書面租約，現時為按月交租的租賃，每月租金為2,000元。
