Order by Deputy High Court Judge K.W. Lung: Leave to apply for Judicial Review be dismissed. Observations for the Applicant: THE APPLICATION 1.The applicant is an illegal immigrant by staying in Hong Kong without permission and he lodged a non-refoulement claim with the Director of Immigration (“the Director”). The Director rejected his application and he appealed to the Torture Claims Appeal Board (“the Board”). Having considered his evidence, the Board, by its Decision (“the Board’s Decision”), rejected his appeal and affirmed the Director’s Decision. 2.The applicant filed Form 86 on 8 July 2019 to apply for leave to apply for judicial review of the Board’s Decision. 3.The Court made an enquiry with the Immigration Department to update the applicant’s address. 4.The Court received a letter dated 19 July 2024, in which the Immigration Department informed the Court that the applicant was removed on 26 February 2024, which means he has already left Hong Kong. 5.Section 37ZF of the Ordinance provides, inter alia,
6.Other than this application, there is nothing outstanding in this action. This application should therefore be dismissed. 7.The application is therefore dismissed. Dated the 20th day of August 2024
