1. The Applicant is a 33-year-old national of the Philippines who arrived in Hong Kong on 25 January 2020 as a visitor with permission to remain as such up to 8 February 2020 when he did not depart and instead overstayed, and 9 months later on 18 November 2020 he surrendered to the Immigration Department and raised a non-refoulement claim for protection on the basis that if he returned to the Philippines he would be harmed or killed by members of the terrorist group the New People’s Army (“NPA”)
