J U D G M E N T

1. In response to my request for clarification of the evidence the Tribunal has confirmed that it found that the payment by the Applicant/Defendant to the Respondent/Claimant was 7 days wages in lieu of notice under Section 7 of the Ordinance. Accordingly the Claimant is entitled to receive long service pay by virtue of Section 31R.

2. I order that the appeal be dismissed. The Orders of the Labour Tribunal are confirmed. The Respondent/Claimant appeared in person. He informed me that he had no current claim for costs. I make an order nisi that there be no order for costs of the appeal with liberty to either party to apply.
