1.On 4 October 2024, we handed down our decision on costs dismissing the appellant’s summons to vary the costs order nisi against him to party and party basis. We made a summary assessment of the Bar Council’s costs on indemnity basis. As costs of the application to vary the costs order nisi have not been included in the statement of costs lodged by the Bar Council, we made an order nisi that costs of the application to vary should follow the event and will be assessed summarily if there is no agreement on the amount by 18 October 2024.

2.The parties have not been able to reach agreement on the amount.

3.Having considered the statement of costs of the Bar Council dated 15 October 2024, we assess the costs to be paid by the appellant at $45,000.
