The Applicant is a 50-year-old national of India who had previously in 2001 entered Hong Kong under a different identity and subsequently overstayed, and was then arrested and deported back to India in the same year, and some 7 years later on 2 April 2008 again arrived in Hong Kong as a visitor under his present identity with permission to remain as such up to 18 April 2008 when he did not depart and instead overstayed, and was arrested by police on 27 April 2008 and subsequently convicted of
