The Applicant is a 56-year-old national of Bangladesh who had previously entered Hong Kong in April 2004 as a visitor and overstayed and was subsequently arrested and repatriated to Bangladesh in May 2005, but more than one year later on 9 October 2006 he again entered Hong Kong under a passport with a different identity and thereafter again overstayed, and was arrested by police one year later on 1 October 2007, for which he was subsequently convicted and sentenced to prison for 10 months.
