1. The Applicant is a 44-year-old national of Vietnam who entered Hong Kong illegally on 19 May 2018 and was subsequently arrested by police, and for which he was convicted and sentenced to prison for 15 months, during which he raised a non-refoulement claim for protection to the Immigration Department on the basis that if he returned to Vietnam he would be harmed or killed by certain local landowner in his home village due to their land dispute.
