COURT: The defendant has pleaded guilty to one count of trafficking in a dangerous drug, contrary to section 4 of the Dangerous Drugs Ordinance and is committed to this court for sentence.
In the evening on 29 September 2023, the defendant was intercepted by police officers in Mong Kok. Inside a bag which the defendant tried to discard during the interception, police officers found 103.8 grammes of cocaine.
The street value was estimated to be over HK$100,000.
In a subsequent video interview, the defendant admitted that due to financial difficulty, he picked up the drugs in question in Tsuen Wan and agreed to deliver them to Mong Kok.
The defendant is 27 and has a clear criminal record. He worked as an air-conditioner installer, making HK$20,000 a month prior to his arrest.
The starting point for trafficking in 103 grammes of cocaine, based on quantity alone, is one of 112 months’ imprisonment.
In this case there is nothing pointing out the defendant’s involvement other than a courier.
The only mitigating factor in this case is the defendant’s earliest plea. For that, he will be given a full one-third discount.
In conclusion, for the offence the defendant stands convicted, he is therefore sentenced to 74 months’ imprisonment.
