1. The Applicant is a 45-year-old national of India who entered Hong Kong illegally on 11 September 2015 after having earlier been refused entry by the Immigration Department and was arrested by police on the same day. After he was referred to the Immigration Department for investigation, he raised a non-refoulement claim for protection on the basis that if he returned to India he would be harmed or killed by members of the banned political party The Community Party of India (Maoist) (“Maoists”)
