1. The Applicant is a 35-year-old national of India who entered Hong Kong illegally in July 2017 and was arrested by police on 6 June 2018. After he was referred to the Immigration Department for investigation, he raised a non-refoulement claim for protection on the basis that if he returned to India he would be harmed or killed by the family of his girlfriend who objected to their relationship. He was subsequently released on recognizance pending the determination of his claim.
