1． 原告人是鍾財的遺孀。鍾財於2000年8月20日去世。他於1998年12月23日在Masons律師樓立下他最後的遺囑，委託他的女兒鍾慶玉為他遺產的承辨人。在遺囑第4段他將他在將軍澳寶明苑A座，25樓20室的業權遺贈給被告人，那業權是不受到任何遺產稅牽制。（即free of all estate and other death duties and taxes）該物業是有按揭給香港匯豐銀行，在他死時還欠259,300元。
