1. 2002年10月24日，上訴人向與訟人租用九龍旺角新填地街451號8樓3號房，每月租金為$2,100。簽訂租約時，上訴人支付了按金$4,200予與訟人。其後租約終止，上訴人向與訟人追回按金未果，遂興訟。
