This is an application by way of Originating Motion to expunge a registered trade mark, No.2400 of 1989, being a device comprising an ancient Chinese 3-legged covered cauldron ("the subject trade mark") which has been registered in Part A of the register in Class 5 covering medicated oil. The application is made pursuant to s.48(1)(a) Trade Marks Ordinance.
