(Pursuant to subsection 55(8), the old method of calculating compensation and apportionment will be used in this matter).

1. The father and the younger brother of the deceased do file an affirmation in support of their claim for payment out within 35 days, that is 7 weeks. The uncle, aunt and younger sister of the deceased do reply thereto within 28 days, so that gives a bit longer all round.

2. The case is adjourned for trial of the issues as to dependency and apportionment to a date to be fixed. Half a day, for parties to attend for cross-examination on their affirmations.

(Discussion re interim payment)

3. I am going to make an interim payment without prejudice to the final outcome of the apportionment. The sum of $200,000 be paid out forthwith to the applicant on behalf of the deceased's father and younger brother.

4. Costs of today in the apportionment. Legal aid taxation of the 2nd respondent's costs.
