____________ Coram: Hon Yuen J in Court Date of Hearing: 11 June 2001 Date of Judgment: 11 June 2001 _______________ J U D G M E N T _______________ 1.This is a petition which was presented in March 2001. 2.In May there was a consent summons by way of an application for an order that the hearing be adjourned to 9 July and I was told on the last occasion that that was because the Company had given the Petitioner two post-dated cheques, one dated 1 June and the other dated 1 July 2001 for the repayment of the debts. There were no other supporting or opposing creditors. 3.On the last occasion, I adjourned the matter to the first Monday after 1 June 2001. However, I have been told today that that cheque has not been honoured. 4.Although the Company's solicitors have not filed a Notice to Cease to Act, they have no instructions to say anything today and it has not been represented by counsel. In the circumstances, as the debt has not been disputed, I will make the usual winding-up order.
