1. In this action the Plaintiff claims against the Defendant under an insurance policy of which it is the assignee. The insurance related to a cargo of chemicals of which the Plaintiff was the buyer from one Indotech Limited ("Indotech"), pursuant to a Sale Contract dated 5th June 1997.
