There appears to be substance in the defendants' proposed appeal here and the plaintiffs do not object to the defendants' time for appealing being extended until 4.00 p.m. on Friday 12 November 1999. There being also reasons which render excusable the defendants' failure to appeal within the prescribed period, I will make the appropriate order. The defendants must pay the plaintiffs' costs of this application. There must also be a taxation of the plaintiffs' costs for the purposes of the Legal Aid Regulations.
