1. The appellant was found guilty of being a suspected person found loitering and sentenced to one month's imprisonment. I dismissed his appeal against conviction. The appellant was on bail Pending the hearing of the appeal and had served nine days of his sentence before bail was granted.

Coram: Briggs, C.J. Date of Judgment: 29th April, 1978. ----------------- JUDGMENT ----------------- 1. The appellant was found guilty of being a suspected person found loitering and sentenced to one month's imprisonment. I dismissed his appeal against conviction. The appellant was on bail Pending the hearing of the appeal and had served nine days of his sentence before bail was granted. 2. The appellant is a man of good character and apart from a traffic offence has a clear record. The offence was not one of a very serious nature and, in my view, it would have been better had a suspended sentence, or a non-custodial sentence even, been imposed. 3. In the event, I think justice would best be done if the appeal against sentence was allowed to the extent that the sentence be reduced so as to enable the appellant to be released on the date of the hearing of the appeal.
