1. I have had the opportunity of reading in draft the judgment of Mr Justice Chan PJ and Mr Justice Nazareth NPJ and also that of Lord Millett NPJ. On the issue of whether the plaintiff company suffered any loss, I agree with the judgment of Lord Millett. On the other issues, I agree with the judgment of Mr Justice Chan and Mr Justice Nazareth and the judgment of Lord Millett.
