1. There are three applications before the court. In HCA No.3492 of 2002, Kenon Engineering Ltd ("Kenon") is the plaintiff and Nippon Kokan Koji Kabusihiki Kaisha, also known as Nippon Kokan Koji Corporation ("NK3") the defendant. NK3 applies that further proceedings be stayed in favour of arbitration or alternative dispute resolution.
