1.This is an application for a certificate under section 32 of the Hong Kong Court of Final Appeal Ordinance, Cap. 484, that certain points of law of great and general importance are involved in the decision of this court which was handed down on 7 July 2001.

2.We are asked to certify on six points which are set out in an undated application, signed by Mr John Haynes on the Applicant's behalf.

3.We decline to grant a certificate on any of the points raised which we do not consider meet the necessary criteria in section 32.
