CACC000307/1971 IN THE SUPREME COURT OF HONG KONG (APPELLATE JURISDICTION) CRIMINAL APPEAL NO. 307 of 1971 -----------------
----------------- Coram: Huggins, J. Date of Judgment: 8th June, 1971. ----------------- JUDGMENT ----------------- 1. The Appellant pleaded not guilty to a charge of unlawful possession of dangerous drugs and he now appeals against his conviction. 2. The evidence was given by a police constable, that he saw the Appellant acting suspiciously and that when he was stopped and searched a packet containing dangerous drugs was found upon him. Necessary evidence of identification of the drugs was produced. The case before the Magistrate and before this Court has been that the whole allegation was a frame-up by the police. The issue was fairly and squarely before the learned Magistrate and he had no hesitation in believing the prosecution. There was evidence to justify conviction and the appeal must be dismissed. 8th June, 1971. Representation: |
