1. I have before me three motions for judicial review which have been selected as test cases to determine a preliminary point of law as to whether s.11 of the Hong Kong Bill of Rights Ordinance (BORO) excludes recourse by illegal immigrants and their family members who have the right of abode in Hong Kong to challenge the Immigration Ordinance under the BORO in respect of the rights of the family and the children.
