HCMA000009/1996 IN THE SUPREME COURT OF HONG KONG (Appellate Jurisdiction) (MAGISTRACY APPEAL NO. 9 OF 1996) ------------------
------------------- Coram : Hon Duffy, J. in Court Date of hearing : 15 February 1996 Date of handing down judgment : 29 February 1996 ---------------------- J U D G M E N T ---------------------- 1. This was an appeal against a sentence of eight months imposed for breach of conditional stay and possession of a false travel document. 2. The sentence was, if anything, on the low side for offences of this sort, but in other respects was perfectly proper. However, the Appellant was able to substantiate his claim that his wife had recently died and therefore, as an act of mercy, I allowed the appeal so that he could be released immediately. Representation: Mr P.S. Chapman, C.C., for Crown Appellant, Abbas Muhammad, in person
