This is an application for vacant possession on the grounds that the Respondent has not paid full rent since 1st February 1999. On 1st February 1999, on the Respondent's own evidence, which is accepted and found as facts of the case, the Respondent paid a sum of $10,000. There was a balance of $7,000 outstanding. He also paid management charge at $1,996 per month up to 31st October 1999. It was not in dispute that the rent was $17,000 per month under the tenancy agreement for the period 1st November 1996 to 31st October 1998. The Applicant and Respondent negotiated on a new tenancy agreement but was unable to agree on the rent. The Respondent insisted on the rent being $10,000 per month. The Applicant did not accept that amount. 2. This is not an application for a new tenancy. Since the previous tenancy agreement expired and no new tenancy was signed, the terms continued as in the previous tenancy agreement.
