FAMV000019/1999 FAMV No. 19 of 1999 IN THE COURT OF FINAL APPEAL OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION MISCELLANEOUS PROCEEDINGS NO. 19 OF 1999 (CIVIL) (ON APPLICATION FOR LEAVE TO APPEAL FROM CACV No. 90 OF 1999) _____________________
_____________________ Appeal Committee: Mr Justice Litton PJ, Mr Justice Ching PJ and Mr Justice Nazareth NPJ Date of Hearing: 1 November 1999 Date of Determination: 1 November 1999 _____________________________ DETERMINATION _____________________________ Mr Justice Litton PJ: 1. This is the determination of the Appeal Committee. 2. This matter goes back to December 1997 when the applicant first commenced proceedings in a form very similar to the present proceeding against various parties, claiming reliefs which have been described in the courts below as "extravagant". Rightly so. The statement of claim was struck out and the action dismissed. The applicant has, since then, appealed against the order, from the Master all the way to the Court of Appeal, failing at each step. On 2 September 1999 the Court of Appeal refused leave to appeal to the Court of Final Appeal. Thus the matter comes before this Committee today. The application is wholly without merit. It is dismissed with costs.
