1. I think Mrs Kaplan is right that these are discrete matters but I would characterise both the matter of 5 November and what has happened yesterday and today as applications that were perfectly reasonable in the circumstances of what was going on and what has happened following the judgment and so I think the fair order and the correct order is to say no order as to costs in respect of those two matters.

But my clerk correctly points out that I delivered that ruling on 31 October as appears on the face of it which was the 19th day of the trial.
