1. The Plaintiff ("P") as owner of Unit No.2 on 4th Floor, Hung King Court (Block F), No.102 Baker Street, Hunghom Bay Centre ("HB Centre"), Kowloon, Hong Kong ("4/F Unit") claimed that there was water leakage to 4/F Unit from the unit directly above on the 5th Floor ("5/F Unit") owned by the Defendants ("D") constituting nuisance and/or breach of the deed of mutual covenant and/or negligence on D's part. P therefore prays for an injunction against D to rectify the water leakage and for damages.
