JUDGMENT

Sir Alan Huggins, V.-P.:

1. We have dismissed this application for leave to appeal out of time and have given reasons therefor. There is another matte which we think we should refer to.

2. There was added to our appeal bundles yesterday an affidavit by a solicitor's clerk of service of some documents. The documents consist of the Notice of Motion, Notice of Appeal and the affidavit in support, copies of which were of course already in the bundles. The exhibited affidavit is, in itself, a short one but it, in turn, has thirteen exhibits all of which were again copied and it seems to us that a great deal of unnecessary paper has been put before the Court when all that was necessary was a reference to the affidavit-the name of the deponent the date upon which it was sworn are the date of filing - in order to identify the document. We have noticed the growing tendency, since the advent of the photocopying machine, to attach more and more paper to affidavits, thus increasing, quite unnecessarily, the cost of litigation, The exhibition of one affidavit to another is, in itself, to be deprecated and we hope that solicitors will use their best endeavours to reduce the amount of paper which is filed in these circumstances.
