The Counter-claim:

[43] Mr. Stanley Siu, counsel for the Defendants, stated in his opening that the counter-claim was no more than an alternative defence. No argument was advanced and no evidence was presented on the counter-claim. The counter-claim is dismissed.

2. in Judgment (1) "The Plaintiff's claim is dismissed" should read :

"The Plaintiff's claim and the Defendants' counter-claim are dismissed."
