1. This is an application by the Defendant for an order that notwithstanding the expiration of the time limit provided and prescribed for serving the Notice of Appeal dated 24th September 1998 pursuant to Order 58 r.1(3) of the Rules of the High Court, the Defendant do have leave to serve his Notice of Appeal within 14 days from the date of the order to be made herein.
