HCCW 188/2005 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF FIRST INSTANCE COMPANIES (WINDING-UP) NO. 188 OF 2005 ____________
____________ Before: Hon Kwan J in Court Date of Hearing: 20 June 2005 Date of Judgment: 20 June 2005 ______________ J U D G M E N T ______________ 1.This petition to wind up Beckon B Co. Limited ("the Company") was presented by Lane Crawford (Hong Kong) Limited. The petition is based on a judgment debt of HK$427,966.28 obtained in DCCJ No. 5703 of 2004 on 30 December 2004. A demand for the debt was made on 10 January 2005 and the petition herein was presented on 9 March 2005. 2.At the hearing before me on 17 May 2005, the Company appeared by counsel and indicated to the court that there might be some basis to say that the service of the writ in the District Court action was irregular. I therefore adjourned the petition to today and gave directions for the parties to file evidence in opposition and in reply. No evidence in opposition has been filed by the Company and its solicitors have ceased to act for it. 3.The petitioner has filed evidence deposing to the manner in which the writ was served in the District Court action. I am satisfied in the circumstances there is no basis for alleging irregular service. I make an order to wind up the Company. The petitioner’s costs would be paid out of the Company’s assets.
