J U D G M E N T

1.This is a petition presented by Mr Ho Kee to wind up Associate Key Development Ltd (“the Company”), on the basis of an award made by the Labour Tribunal on 20 October 2004 in the sum of HK$13,042.62 with interest.

2.The petitioner served a demand for the judgment debt on the Company on 19 July 2005 and the petition was served on 13 October 2005.  At the hearing before a Master on 9 November 2005, the Company was present by a director and had opposed the petition.  As I understand it, the Company did not dispute the petitioner’s debt before the Master but had only asked for time to pay an outstanding sum of about HK$10,000.00.  The petitioner has declined to give further time to the Company to pay.

3.At the hearing today, the Company has not appeared.  As the petitioning debt has not been settled in full and it is not in dispute, I make an order to wind up the Company.  The petitioner’s costs are to be paid out of the Company’s assets.
