1.Pursuant to paragraph 102 of the Judgment (dated 23 May 2006), written submissions were received from the 2nd to 4th plaintiffs seeking an order that the 4th defendant be made jointly liable with the plaintiffs for the 1st defendant’s costs in the Court of Final Appeal and/or the courts below.

2.Written submissions in response were received from the 4th Defendant.

3.No basis has been made out for the order sought by the 2nd to 4th plaintiffs and it is accordingly ordered that the costs order nisi that the plaintiffs pay the 1st defendant’s costs in this Court and below be made absolute.
