1. This is a petition presented by J.K.N. International Limited against Long To Cotton Yarn Company Limited (“the Company”).  The petition is founded on a judgment debt in HCA No. 817 of 2005 obtained on 7 June 2005.  The Company was ordered to pay the petitioner $1,807,850.00 with interest and fixed costs.  A demand for the judgment debt was served on the Company on 30 November 2005, and this petition was presented on 26 January 2006.

J U D G M E N T

1.This is a petition presented by J.K.N. International Limited against Long To Cotton Yarn Company Limited (“the Company”).  The petition is founded on a judgment debt in HCA No. 817 of 2005 obtained on 7 June 2005.  The Company was ordered to pay the petitioner $1,807,850.00 with interest and fixed costs.  A demand for the judgment debt was served on the Company on 30 November 2005, and this petition was presented on 26 January 2006.

2.When the petition first came before Deputy Judge Poon on 8 May 2006, the parties sought an adjournment for negotiation.  After two adjournments, I am informed by counsel for the petitioner today that they have not reached any settlement, and the petitioner seeks a winding-up order.

3.I make an order to wind up the Company.  The petitioner’s costs are to be paid out of the Company’s assets.
