Please note the following corrigendum in the Judgment handed down on 20 July 2006:-

Page 24

Line I at paragraph 35 should read “Accordingly, I would make a costs order nisi that there be no order as to the costs of the appeal.”  The words ‘save for legal aid taxation of the respondent’s costs in accordance with the Legal Aid Regulations’ should be deleted.

Line R at paragraph 37 should read “Accordingly, the appeal is dismissed.  There will be a costs order nisi that there be no order as to the costs of the appeal.”  The words ‘save that the respondent’s costs be taxed in accordance with the Legal Aid Regulations’ should be deleted.
