1. I have had the benefit of reading in draft the judgment of Sakhrani J and I agree with his reasons and the orders he proposes at paras. 69 and 70. I should add however that I have not found this an easy case and I confess that if I had put myself in the shoes of Judge Komar, I may not have issued the letter of request without first requiring a further amendment to the pleadings to specifically plead the MOT transactions.
