1. Elsun (the Plaintiff) is the purchaser and Chin (the Defendant) is the vendor of the middle floor of a 3-storey small village house in Sai Kung, New Territories, under a preliminary sale and purchase agreement in 2007. Elsun commenced this action essentially for specific performance of the preliminary agreement. Chin contends that she has exercised her contractual right to cancel the transaction. Elsun now applies for summary judgment.
