1. On 30 th November 2007, the Plaintiff commenced the present action for damages for personal injuries sustained in a traffic accident on 18 th April 2007 (“ Accident ”), which was caused by the negligent driving of the 1 st Defendant for whom the 2 nd Defendant was allegedly vicariously liable. The Statement of Damages averred that the Plaintiff suffered neck sprain injury, and her present complaints were neck pain and tightness at neck.
