J U D G M E N T

----------------------

1.On 28 August 2008 this court dismissed an appeal, CACV 207 of 2008, from a decision of Lam J given on 25 July 2008.  That decision by the judge was that the application before him was incomprehensible.  This court considered that the judgment was correct and simply dismissed the appeal.

2.By fax dated 25 September 2008 Ms Yuen requested this court to consider an application for leave to appeal to the Court of Final Appeal on paper in respect of CACV 207 of 2008.

3.This court accedes to the request by the appellant that the applications for leave to appeal to the Court of Final Appeal should be dealt with on the basis of submissions already made and written submissions.  It should be noted that it would appear that the application is not in the proper form, nevertheless as this court saw no merit in the appeal to this court, let alone any appeal to the Court of Final Appeal, we consider that this court would in any event have no alternative but to dismiss any application for leave to appeal.
