APPELLATE JURISDICTION

CRIMINAL APPEAL NO. 676 OF 1968

-----------------

BETWEEN
YU MING Appellant

AND

THE QUEEN Respondent

Coram: Huggins, J.

Date of Judgment: 26 November 1968

JUDGMENT

-----------------

Huggins,J:

The appellant was in custody in the Victeria Reception Centre. He was there found to be in possession of two packets of dangerous drugs. His excuse was that they had been given to him by another prisoner because he was in agony with stomach-ache. The learned magistrate passed a sentence of 15 months' imprisonment intending it to be a deterrent penalty. In my view it was a proper sentence and the appeal is dismissed.

26th November 1968.
