COURT: The accused, can you stand up?

I have taken into account everything urged on your behalf by your counsel. As for the robbery, it was accompanied by violence even leaving out of account, as I do, the violence that resulted in death.

All things considered, I am of the view that the appropriate starting point for robbery, subject to the discount for your guilty plea to it, is 7 years’ imprisonment. Giving you a discount of one-third, I sentence you to 4 years and 8 months’ imprisonment for the robbery.

For murder, the sentence is prescribed by law, and I pass on you that sentence which is life imprisonment. For the murder, you will go to prison for life.

Accused's application for leave to appeal his conviction of murder granted by Court of Appeal. Appeal allowed, conviction of murder quashed. Please refer to CACC93/2009 dated 7 September 2011
