CRIMINAL APPEAL NO. 692 OF 1972

BETWEEN
  LAM WAH Appellant
  and
  THE QUEEN Respondent

JUDGMENT

-----------------

1. The Appellant appeals against a sentence of twelve months' imprisonment for unlawful possession of dangerous drugs. He was found to have one packet containing 0.4 gramme of a mixture containing 0.2 gramme of salts of esters of morphine. His complaint is that some defendants have been sentenced to shorter terms of imprisonment although they had more drugs. I can well understand that they have. The Appellant is a man of 27 years of are and he already has been before the court on five previous occasions for unlawful possession of drugs. On two occasions he was bound over: on one he was placed on probation. He has been to a Training Centre and he has been to a Drug Addiction. Treatment Centre. He has been given every possible assistance to give up this addiction to drugs. He has not availed himself of the opportunities offered. With a record like that I fail to see how he can consider this an excessive sentence. It was entirely proper and the appeal is dismissed.
