By judgment dated 23 December 2008, Registrar Au-Yeung struck out the plaintiff’s claim and dismissed the action under Order 18, rule 19(1)(a) of the Rules of the High Court, and made an order nisi that the plaintiff should pay the defendant costs assessed at HK$15,000 (“the 1 st Order”).
